Sodomy is a form of sexual harassment that is quite common in society. The impact can also affect the victim physically and psychologically in the long term. Therefore, every perpetrator of sodomy needs to get the punishment he deserves.

Sodomy is sexual harassment committed by inserting the penis into the anus. According to the Big Indonesian Dictionary (KBBI), sodomy can be defined as an act of sexual immorality between the same sex, usually between men, or with animals.

This act of harassment provides deep trauma and long-term impact on the victim. However, many victims are afraid to report their cases of sodomy. In fact, the act of sodomy is one of the immoral crimes and the perpetrators can be snared with severe punishments.

The act of sodomy will certainly have a negative impact on the victim's body, either in the form of wounds or infectious diseases. There are several conditions or diseases that can be experienced by victims of sodomy, including:

  • Chronic abdominal pain and pelvic pain
  • Sexually transmitted diseases, such as HIV, hepatitis B, and gonorrhea
  • Anus muscle disorders, such as pooping in the pants (encopresis) or pain during bowel movements

In addition, victims of sodomy can also experience problems in sexual intercourse and sleeplessness.

Laws governing the crime of sodomy in Indonesia

Sodomy makes its victims feel uncomfortable, afraid, or anxious. There are various reasons why someone commits sodomy, ranging from wanting to show power, committing violence, to exercising control over the victim. 

Although it has not been specifically regulated, acts of sodomy can be categorized as obscenity and in practice, acts of sodomy can be subject to articles on obscenity.

Obscenity can be defined as any act that violates decency or a heinous act involving lust, including touching the genitals and forcibly having intercourse.

Perpetrators of obscenity, including sodomy, can be charged with Article 289 of the Criminal Code with a maximum imprisonment of 9 years. In addition, perpetrators of sodomy can also be charged with Article 290 of the Criminal Code with a maximum prison sentence of 7 years.

Articles of obscenity against minors

If same-sex sodomy is committed against a minor with an adult perpetrator, the perpetrator will be subject to Article 292 of the Criminal Code with a maximum penalty of 5 years in prison.

Meanwhile, obscene acts committed against minors are specifically regulated in Article 82 of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection.

This article regulates the threat of imprisonment for a minimum of 5 years and a maximum of 15 years, as well as a maximum fine of 5 billion rupiah for perpetrators of sexual abuse.
